The applicant is the sole accused in Crime No.861/2020 of Vanchiyoor Police Station, Thiruvananthapuram for having allegedly committed offences punishable under Sections 341, 294(b), 506(ii), 323, 324 and 326 of IPC

The prosecution case in brief is that on 06.06.2020 at about 6.00 p.m., near Paramount Digital Press at Chettikulangara Junction in Vanchiyoor, the applicant wrongfully restrained the de facto complainant hurled abuses at him, intimidated him with death and thereafter assaulted him with a piece of concrete, as a result of which, the de facto complainant lost two teeth and consequently the crime was registered. The applicant states that the allegations are false and frivolous and he admits that there was some altercation between them and in the scuffled that ensued the de facto complainant fell down and lost his teeth. The applicant was not the reason for the de facto complainant loosing his teeth. He has no criminal antecedents. He is willing to co-operate with the investigation. Therefore, he may be released on bail.

Heard the learned counsel for the applicant and the learned Public Prosecutor.

The learned Public Prosecutor admits that the applicant has no

criminal antecedents. He is willing to co-operate with the investigation. I find no reason why he should be confined to custodial interrogation.

In the result, the application is allowed. The applicant is directed to surrender before the investigating officer within two weeks. After interrogation and recovery if any, he shall be released on bail on execution of a bond for Rs.50,000/- (Rupees fifty thousand only) with two solvent sureties each for the like amount to the satisfaction of the investigating officer and on following conditions:

(i) He shall appear before the investigating officer as and when called for,

(ii) He shall not also attempt to influence the witnesses or tamper with evidence and,

(iii) He shall not get involved in any other similar crimes during the currency of the bail.

In case of violation of any bail condition, the prosecution is at liberty to apply for cancellation of the bail before the jurisdictional court.
