The applicant is the sole accused in Crime No.129/2018 of Kottiyam Police Station, Kollam for having allegedly committed offences punishable under Sections 419, 420, 465, 468, 471 of IPC and under Section 12B of the Passports Act.

The prosecution case in brief is that the applicant had obtained a passport in the year 1991 after impersonating as Shaji whereas his real name is Thrideep. The applicant states that he was only 19 years of age at that time when he applied for passport and that his father had actually furnished the details for the passport applied through an agent and because of utter poverty he had gone abroad using that passport and got employed there and now he has returned home. The crime was registered in the year 2018. The applicant states that he does not have any knowledge of English and could not understand the consequence of not mentioning his correct name in the passport. Anyhow, he has no other criminal antecedents. He is willing to co-operate with the investigation. I find that custodial interrogation of the applicant may not be necessary as the passport has already been seized.

In the result, the application is allowed. The applicant is directed to surrender before the investigating officer within two weeks. After interrogation, in the event of his being arrested, he shall be released on bail on execution of a bond for Rs.50,000/-(Rupees fifty thousand only) with two solvent sureties each for the like amount to the satisfaction of the investigating officer and on following conditions:

(i) He shall appear before the investigating officer as and when called for,

(ii) He shall not also attempt to influence the witnesses or tamper with evidence and,

¶25

(iii) He shall not get involved in any other similar crimes during the currency of the bail.

In case of violation of any bail condition, the prosecution is at liberty to apply for cancellation of the bail before the jurisdictional court.
