A.C.Vidya, the learned Government Pleader appearing for the respondents that written instructions has been furnished by the Additional Tahsildar, Mavilikkara, where it is stated that the second petitioner had applied for demarcation of the land in re-survey number 736/11, block level of Kannamangalam Village, Mavelikkara Taluk. And that as per the provisions contained in the Survey and Boundaries Act, notices in Form-6 was issued to the petitioner and the neighbouring land owners and the Taluk surveyor had conducted the survey in the presence of the applicant and re-fix the eastern boundary points and convince the same to the applicant. Some of the public has claim that they have used the boundary points as public path and the raised objections in placing boundary stones and hence boundary stones could not be placed by the surveyor. The second petitioner was satisfied in the process of measurement made by the surveyor and she is convinced about the boundary fixation of the eastern side. The second petitioner Taluk Surveyor had submitted report stating all the above facts on 22.01.2016. That the eastern boundary is a canal purambok and it is used as a common pathway by the public and the persons who are using pathway objected to the re-fixation of the eastern boundary and due to this, the surveyor
