any enabling law for compulsory acquisition of land as in The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 or any such other valid law on the said subject matter. Without any such compulsory acquisition proceedings, petitioner's property cannot be forcibly acquired or taken over even for public purpose. It is also made clear that in case the official respondents have a case that the petitioner has encroached into government property/public property/PWD road, then it will be open to them to conduct survey/measurement and demarcation of property, with due prior notice to the petitioner, to ascertain whether the petitioner has encroached into any such Government property/public property. Copies of the report of the Surveyor and the sketch should also be given to the petitioner and only after giving an opportunity of being heard, the factual position as to whether petitioner has encroached into Government property/public property shall be decided and only after such due process can steps be taken for removal of any such alleged encroachment.
