amounting to Rs.44,430/- within four weeks from the date of the order and also to pay the rent @Rs.1,380/- for the subsequent period which may fall due, within 15 days from the date on which it falls due. Though the said order was passed by the Rent Control Court, the petitioner did not pay the said amount. Instead, the petitioner sent two Demand Drafts of Rs.13,000/- dated 01.10.2016 and Rs.20,000/dated 05.12.2016 respectively. He did not prefer to file a counter. In the absence of the deposit of full amount, the Rent Control Court stopped all further proceedings and passed an order directing the petitioner to put the respondent in possession of the building. Aggrieved by the said order, though he had preferred RCA.No.88/2017 before the Rent Control Appellate Authority, Kozhikode, after reappreciating the evidence on record, the Appellate Authority also concurred with the findings of the Rent Control Court and dismissed the appeal. Thus, the legality and propriety of the concurrent findings of the court below granting an order of eviction under Section 12(3) of the Act have come up in revision before us.
