the same was executed by fraud and coercion. The petitioner had then initiated proceedings under the Rent Control Act seeking eviction of the respondents from the above said premises, by filing Rent Control Petition before the Additional Rent Control Court. At that stage, the respondents have taken up the contention of bonafide denial of title and hence the parties were relegated to Civil Court. Thereafter, the petitioner had preferred Original Suit, O.S. No.523 of 2016, before the Munsiff's Court, Palakkad, which was subsequently re-presented before the Court of the Addl. Subordinate Judge, Palakkad, wherein it has been renumbered as O.S. No.17 of 2017. The Court below has allowed an application for joint trial, whereby O.S.169 of 2012 filed by the respondents and O.S.17 of 2017 filed by the petitioner herein were ordered to be jointly tried by the Court of the Additional Sub Judge, Palakkad and the cases were posted for trial in the special list on 02-03-2018 (today). It is the further case of the petitioner that petitioner's daughter is always having problem of falling unconscious and she has been medically advised to be treated at Super Speciality Hospital at Coimbatore and that the petitioner is not in a position to attend the court below and adduce evidence on 02-03-2018. The petitioner had preferred Ext. P-6 I.A. No.729 of 2018 in O.S. No.17 of 2017, praying that the case is to be removed from the list and may be taken up only after two months.
