Meanwhile, on the information given by the accused-doctor Crime No.86/CR/99 was registered by the CBCID in connection with the very same incident for the offences under Sections 294(b), 307, 323, 325, 326 and 506 IPC. At the same time, on 27.3.2008 the Government granted sanction under Section 197 Cr.P.C. to prosecute the accused-police officer. The accused-police officer on 24.10.2008 filed C.M.P. No.4928 of 2008 in the court of the Additional Chief Judicial Magistrate alleging that the accused-doctor and some others made false entries in the treatment records of the accused-doctor and made false records in connection with his treatment. The learned Magistrate forwarded it to the police under Section 156(3) Cr.P.C. Accordingly, Crime No.578 of 2008 was registered at the Medical College Police Station against the accused-doctor and some other doctors for the offences under Sections 193, 196, 417, 465, 468 and 471 IPC. The investigating officer filed a final report, which was taken on the file of the Additional Chief Judicial Magistrate, Thiruvananthapuram as C.C. No.20 of 2012.
