Petitioners herein are arrayed as accused Nos.2 to 5 in Crime No.275 of 2018 of Aryanadu Police Station for offences punishable under sections 308 and 354 of the Indian Penal Code.

It is stated that, due to previous enmity, petitioners herein wrongfully restrained the defacto complainant and others on 20.02.2018 and attacked him. Specific overt act is attributed to the first accused, who hit on the face of the defacto complainant with a stone. It is stated that the first accused was arrested and later released.

Having considered the nature of allegations and the overt act attributed to the petitioners herein, I am inclined to grant the benefit of pre-arrest bail to the petitioners herein subject to the following conditions.

(i) Each of the petitioner shall appear before the Investigating Officer within ten days from today and shall undergo interrogation. If they are proposed to be arrested, they shall be released on bail on they executing a bond for a sum of Rs.40,000/- (Rupees forty thousand only) with two sureties for the like sum each.

(ii) They shall appear before the Investigating Officer on all Tuesdays and Saturdays between 10 a.m. and 11 a.m. for a period of two months from the date of execution of the bond as above.

(iii) They shall not threaten, coerce or intimidate the de facto complainant or his witnesses.

(iv) They shall not get involved in any other offences.

¶37

The anticipatory bail application is allowed as above.
