Petitions filed under Section 439(1) Cr.P.C.

Petitioner is the accused in Crime Nos.248 of 2015 and 687 of 2015 of Nedumangad Police Station and Crime No.348 of 2015 of Pangode Police Station pending before the Court of Judicial First Class Magistrate, Nedumangad as C.C.678 of 2016, C.C.679 of 2016 and C.C.No.180 of 2016 respectively registered for the offence of theft and related offences. He is involved in several other cases. Except in these cases and another case pending on the file of the Judicial First Class Magistrate Court, Kattakkada, he is on bail. His request is to grant him bail. The main reason is that he is now a reformed man.

Heard the learned counsel for the petitioner and the learned Public Prosecutor.

The total number of cases in which the petitioner is involved is about 50. All are for the offence of theft and related offences. His submission is that now he is a reformed man. That may or may not be true. The report of the learned Magistrate

shows that the above three cases will be disposed of within six months. It is the submission of the learned counsel that the petitioner may be granted bail atleast for one month so that he may marry off his daughter. By the order dated 24.1.2017, he was granted bail for a brief period to enable him to marry off his daughter. But unfortunately the marriage could not be solemnized

as he did not get sufficient time to make necessary arrangements. Having regard to these facts, I am inclined to grant him bail for 45 days.

In the result, these Bail Applications are allowed as follows:

i. The petitioner shall be released on bail on 22.3.2017 till 10.5.2017.

ii. He shall surrender before the Superintendent of Jail before 4 p.m. on 10.5.2017.

¶30

iii. He shall execute a bond for Rs.50,000/- with two solvent sureties each for the like sum to the satisfaction of the lower court concerned.

iv. He shall appear before the Investigating Officer on alternate days between 3 p.m. and 4 p.m. before the Station House Officer, Nedumangad Police Station during this period.
