The petitioner is the 6^th accused in Crime No.100/2017 of Thidanadu Police Station registered for the offences under Sections 120B, 420, 468, 471 and 506 of Indian Penal Code. The Bail Application No.1554/2017 filed by him under Section 438 Cr.P.C was dismissed by this Court on 11.04.2017. Now this application has been filed under the same provision mainly on the ground that three of the co-accused including the first accused have been granted anticipatory bail.

Heard the learned counsel for the petitioner and the learned Public Prosecutor.

It is not in dispute that accused Nos.1, 4 and 5 have been granted anticipatory bail by this Court or by the Sessions Court. I think the petitioner also is entitled to get a similar order.

In the result, this Bail Application is allowed on the following conditions:

i) The petitioner shall be released on bail on his executing a bond for Rs.1,00,000/- (Rupees One Lakh only) with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate.

ii) He shall appear before the investigating officer for interrogation as and when he is required.

¶30

iii) He shall surrender his passport in the court below within seven days from today or if he does not have one, he shall file an affidavit to that effect.

iv) He shall not leave the country except with the previous permission of the court concerned.

¶32

v) He shall not intimidate or attempt to influence the witnesses, nor shall he get himself involved in any other criminal case.

vi) He shall not destroy or tamper with evidence.

¶34

vii) In case of violation of any of the above conditions, the learned Magistrate is empowered to cancel the bail in accordance with law.
