Petition filed under Section 439 Cr.P.C.

The petitioner is the accused in Crime

¶24

No.1000/2013 of Kuttippuram Police Station registered for the offences under Section 420 IPC. The prosecution case is that he collected Rs.3 Lakhs from the first informant in 2008 making a false promise. He has been in custody since 17.12.2016. Final report has already been filed.

The learned Public Prosecutor submits that several cases have been registered against the petitioner. Since the final report has already been filed, his detention is not necessary in this case.

In the result, this application is allowed.

The petitioner shall be released on bail after

interrogation on his executing a bond for Rs.1,00,000/- (Rupees One Lakh only) with two solvent sureties for the like sum to the satisfaction of the learned Magistrate concerned.

He shall appear before the Investigating Officer

for interrogation between 11 am and 12 noon on every 1^st and 3^rd Saturdays for three months or till the final report is filed whichever is earlier.

He shall not destroy or tamper with evidence.

He shall not leave India without the previous

permission of the court of enquiry or trial court as the case may be.

In case of violation of any of the above conditions, the learned Magistrate is empowered to cancel the bail in accordance with the law.
