JUDGMENT

The petitioner, who was appointed as HSA (English) in Aleemul Islam Higher Secondary School, Padoor, Thrissur District, which is an aided school, is aggrieved by the refusal to grant of approval to her appointment. As against the order Ext.P2 dated 31.2.2012 passed by the District Educational Officer, the petitioner had approached the Deputy Director of Education who also rejected her claim. As against that rejection, the petitioner has preferred Ext.P6 revision petition before the Director of Public Instructions.

The learned Counsel for the petitioner submitted that even though the revision petition was submitted as early as on 9.4.2013, the same is not considered and disposed of so far. It is also pointed out that during the pendency of this writ petition two 51A claimants who were awaiting appointments as referred to in Ext.P2 order of the District Educational Officer, have already been given appointment and as at present the objections raised

against her appointment in the orders passed by the District Educational Officer as well as the Deputy Director of Education do not subsist. In these circumstances, the petitioner is free to submit a supplementary representation before the Director of Public Instructions, in case revision Ext.P6 is pending before him.

In the above circumstances, the writ petition is disposed of, directing the first respondent to pass orders on Ext.P6 revision petition after affording an opportunity of hearing to the petitioner and the parties if any who are likely to be affected, within a period of three months from the date of receipt of a copy of this judgment. Petitioner shall produce a copy of the judgment along with the supplementary representation before the Director of Public Instructions within a period of two weeks from the date of receipt of a copy of this judgment.
