of the remaining rooms. The petitioner submits that the Municipality had passed Ext.P6 resolution dated 7.5.2009 to allot rooms to all other occupants of the old shopping complex in the new shopping complex on receiving deposits at the rates fixed in that meeting. Aggrieved by the refusal to allot him a room as in the case of other occupants, he submitted Ext.P8 petition dated 7.7.2010 to the Government under section 57 of the Kerala Municipalities Act. Producing Ext.P12 letter dated 17.1.2011, the petitioner submits that even though Government had called for a report from the Municipality, after considering his claim for rehabilitation, neither the Municipality took any action nor the Government passed any final order on the request of the petitioner. The petitioner submits that in Ext.P9 report dated 29.8.2010 of the Municipality, submitted before the Government, in respect of the petitioner's complaint, the Municipality had admitted that the petitioner had withdrawn the writ petition that he had filed against his eviction, on the basis of a settlement talks and that he was permitted to run a stall in the market, though it denies any assurance having made for his rehabilitation in the new building, on demolition and reconstruction of the old shopping complex, saying that there was no material to support the claim of the petitioner.
