Relying on Ext.P10 judgment of this Court, the petitioner challenges Ext.P8 order of the Debt Relief Commission as well as Exts.P2, P4, P5 and P6 orders. By Ext.P8 the Debt Relief Commission rejected the request of the petitioner for relief under the Farmers Debt Relief Scheme, saying that the loan availed by petitioner was for construction of house. It was also stated that the petitioner had availed debt relief under coffee package and he is not entitled to any further relief. As per Ext.P4 order, the Joint Registrar of Cooperative Society also rejected his claim on the ground that no waiver is admissible to housing loan and loans other than agricultural loans. It was stated that he is not entitled to any benefit other than waiver of penal interest as the term of the loan was to expire only on 01.04.2013 and as on 01.04.2008, a sum of Rs.2,24,372/- was due in his loan account. He was informed that the facility of writing off was not available for the loan availed by him as it was not an agricultural loan under the Central or State Scheme.
