The petitioners seek a direction to provide police protection, for implementing Ext.P1, saying that vacant possession of the factories and premises of the cashew factories are not returned to them despite Ext.P1 judgment dated 11.06.2009 in O.P.No.38671 of 2002. The petitioners are legal heirs of the Late Govindaraja Reddiar, who was the owner of the 2 cashew factories in Kottarakara. Those factories were leased out to the second respondent-Kerala State Cashew Development Corporation and the lease was being renewed upto 30.11.1990. Petitioner's case is that the factories were taken over by the 2nd respondent “vide notification under Section 3 of the Kerala Cashew Factories (Requisitioning) Amendment Act 26/1985 published in Gazatte notification dated 29.04.1997.” Alleging that the 2nd respondent was holding possession of the factories illegally since 1990 and was not handing over the factories even after the expiry of the time stipulated in the judgment, despite repeated requests, the petitioners filed this writ petition on 7.7.2010, seeking police protection for implementing Ext P1 judgment and for direction to the 2nd respondent to compensate the petitioners.
