Ext.P6 dated 9.3.2006 of the Accounts Officer of the 2nd respondent in which he had requested Government for sanction for payment of pension arrears of petitioner for the period from 1.1.2003 to 31.10.2005, since the amount exceeded Rs.75,000/- (Rupees Seventy five thousand only). The petitioner thereupon submitted Ext.P7 representation before the Chief Minister requesting for sanctioning of pension with retrospective effect and it was requested to sanction pension for the period from 1987 to 2012 onwards also pointing out that pension was sanctioned only with effect from 1.10.2003 onwards. But that representation was rejected as per Ext.P8 letter dated 22.5.2006, stating that his claim was not admissible according to the Kerala Freedom Fighters Pension Rules, which provides that in the case of all applications received after 15.8.1972, pension can be sanctioned only with effect from the date of sanctioning of pension by the District Collector. It was also pointed out that the petitioner's application was considered after condoning delay in submitting the application and therefore his request for pension with retrospective effect cannot be allowed.
