as well as Sales Assistant Special grade even in the absence of pass in SSLC. It was also pointed out that several persons without SSLC were granted promotion,while he alone was left out. The petitioner submits that the 2nd respondent and several other persons were granted promotion. He had earlier filed WPC No.23954/1992 before the High Court of Karnataka. As per Ext.P4 judgment dated 6.9.1999, the said writ petition was allowed to be withdrawn reserving liberty to raise all the contentions raised in that writ petition in a dispute pending before the II Addl. Labour Court, Bangalore. The petitioner submits that some of the benefits claimed by him were granted by the Labour Court by its order dated 31.8.2002. Challenging the said order, to the extent it denied certain reliefs, petitioner filed WP(C) No.17513 of 2003. The petitioner submits that the writ petition was allowed by judgment dated 16.9.2005 and the writ appeal filed by the respondents were dismissed. It is under this circumstance that the petitioner approached this court for ventilating his grievances against the denial of promotion, pointing out that the persons like the 2nd respondent were granted promotion despite the fact that they did not have SSLC.
