O R D E R

The above review petition has been filed taking a

ground that in fact, this Court had granted an adjournment to 16.03.2016 and had inadvertently taken up the matter in the hearing list on 15.03.2016 and disposed of the same on the very same day. Though the learned Counsel for the respondent submits that he was never informed of the said adjournment, the petitioner's counsel has, in the review petition, specifically stated

that he had argued one another matter on the same day which

was disposed of and he had, in fact, sought for an adjournment

of the aforesaid writ petition which was listed as 835 in the hearing list on the very same day. There is nothing to disbelieve

the statement made by the learned Counsel for the petitioner.

In such circumstance, the review petition is allowed. Judgment

in W.P(C) No.33728/2006 dated 15.03.2016 is recalled. The

Registry shall post the writ petition according to roster.
