in order to save the property, some more time can be granted to the petitioner, so that he can pay the same in instalments. The counsel for the petitioner submitted that he will pay a further amount of Rs.50,000/- on 30.10.2016 and the balance amount can be paid in ten instalments thereafter. But this court feels that the suit is of the year 2013, only when execution proceedings are initiated in 2015, he had made some payment. So the property was brought to sale and several steps have been taken by the decree holder to bring the property for sale as well. So considering the circumstances, ten months period asked by the petitioner appears to be on the higher side. However, this court feels that the petitioner can be granted 8 months time to pay the amount. First instalment of Rs.50,000/- will have to be paid on or before 30.10.2016 and the balance amount will have to be paid in seven equal monthly instalments starting from 30.11.2016 and the last payment will have to be made on or before 17.06.2017. If the petitioner commits any default of payment of any of the instaments, then court below is entitled to proceed with the execution of sale of the property on the same sale proclamation proclaimed by the court.
