The petitioner in both these cases is the Secretary of Madhur Grama Panchayath. The respondents herein filed OS.No.364/2014 before the Principal Munsiff Court, Kasaragod as Ext.P1 for permanent prohibitory injunction restraining the defendants from blocking B schedule road cum pathway leading to A schedule property and house of the plaintiff. During the pendency of the case, the allegation was that the panchayat closed the pathway by constructing a compound wall. So the respondents filed IA.No.2158/14 for interim mandatory injunction. The respondents though opposed the application, the Munsiff passed an order dated 15.12.2014 granting relief of interim mandatory injunction directing the second respondent in the court below, who is the petitioner herein and his men to remove the laterite compound wall constructed by them in the plaint B schedule road as noted by the advocate commissioner within 10 days failing which the petitioner was permitted to do the same through court. This order was challenged by the petitioner by filing CMA.No. 1/15 before the District Court, Kasaragod which was confirmed by that court and that was challenged by the petitioner by filing OP(C)No. 1027/2015.
