Petitioner herein is the sole accused in Crime No.1010 of 2015 of Koothattukulam Police Station for offences punishable under Sections 325, 323, 294(b) and 302 of the Indian Penal Code.

The allegation of the prosecution is that on 29.11.2015 at about 8.20p.m., accused kicked and stamped on the chest of the deceased. It is alleged that other blows were also inflicted on his body. While he was proceeding to his house, he fell down and succumbed to the injuries. Substantial damage caused to the 3^rd and 6^th ribs affected his liver. Petitioner herein was arrested on 16.12.2015 and is in custody since then.

Learned Public Prosecutor, opposing the application, submitted that the investigation is progressing, but it is not likely that final report will be laid within the statutory period. It appears that the substantial part of the investigation is over. Crucial witnesses are questioned and their statements recorded. Having regard to these facts, I am inclined to grant bail to the petitioner subject to the following conditions.

(i) Petitioner shall execute a bond for a sum of Rs.60,000/- (Rupees sixty thousand only) with two sureties for the like sum each to the satisfaction of the jurisdictional Court.

(ii) He shall appear before the Investigating Officer on all Mondays and Saturdays between 9 a.m. and 10 a.m. for a period of two months from the date of his release.

(iii) Except for the compliance of the above condition or for appearance in a Court of law where his appearance is mandatorily required, he shall not enter the limits of Koothattukulam Police Station for a period of two months from the date of his release.

(iv) He shall not threaten, coerce or intimidate the de facto complainant and the witnesses nor shall he interfere in the process of investigation.

(v) He shall not get involved in any other identical offences.

The bail application is allowed as above.
