The petitioner is the 3^rd accused in Crime No.766 of 2015 of Bekal police station for offences punishable under Section 379 IPC and Sections 20,21 of Kerala Protection of River Banks and Regulation of Removal of Sand Act.

The allegation of the prosecution is that on

10/12/2015 at 4.30 p.m the petitioner herein along with two other accused were found transporting river sand illicitly in a pick up van. When the accused were intercepted, the petitioner herein ran away from the spot. Crime was registered and the petitioner seeks bail.

Heard and examined the records.

The learned public prosecutor submitted that the

accused is involved in three other cases. However, those three cases are not offences of same nature as that of the present

one. Further, substantial part of the investigation is over with search, seizure and preparation of mahazar. Hence, I am inclined to grant bail to the petitioner subject to the following conditions.

i). The petitioner shall appear before the investigating

officer within ten days from today and shall undergo interrogation. Thereafter if he is proposed to be arrested, he shall be released on bail, on he executing bonds for a sum of Rs.

¶34

40,000/- (Rupees Forty Five thousand ) with two sureties each. ii). He shall co-operate with the investigation and shall

not threaten, coerce or intimidate the witnesses .

Iii). He shall not get involved in offence of identical nature. The bail application is allowed as above.
