Petitioner is the second accused in Crime No.1275 of 2015 of Vatakara Police Station for offences punishable under Sections 143, 145, 147, 148, 324, 323, 326, 307, 353, 332 r/w Section 149 of the Indian Penal Code.

The allegation of the prosecution is that in connection with an election, there arose a fight between two groups of political parties. On getting information, the de facto complainant who is the driver of the police along with the party had gone to the spot. While so, accused including the second accused attacked the de facto complainant. In the course of the incident, it is alleged that he lost two teeth. It is also alleged that they also hit on the various parts of the body of the de facto complainant. No specific overt act is not seen committed by the second accused.

Learned counsel for the petitioner has produced before me the certificate of the College of Engineering and Technologies, Payyannoor to indicate that he is studying in 7^th semester examination and has been undergoing examination during the relevant time. appears to have substantially progressed in so far as it relates to the petitioner herein. Hence, I am inclined to grant bail to the petitioner subject to the following conditions.

(i) Petitioner shall execute a bond for a sum of Rs.40,000/- (Rupees forty thousand only) with two sureties for the like sum each to the satisfaction of the jurisdictional magistrate.

(ii) He shall appear before the Investigating Officer on every Saturday between 9 a.m. and 10 a.m. for a period of one month from the date of execution of the bond as above.

(iii) He shall not threaten, coerce or intimidate the witnesses nor shall he interfere in the process of investigation.

(iv) He shall not get involved in any other identical offences.

¶26

The bail application is allowed as above.
