The petitioner is the accused in Crime Nos.134/2015 and 139/2015 of CBCID Kannur for offences punishable under Sections 406, 420, 506(ii), read with 34 of IPC.

The identical facts involved in both the case is that the petitioner herein along with others had offered to procure seats for MBBS in various medical colleges and had received huge amounts from the respective de facto complainants. According to the petitioner herein it was his son, who had received the money and he has personally undertaken to discharge the liability created by the son in Crime No.134/2015. In Crime No.139/2015 he himself is involved having allegedly received the advance amount.

The crux of the allegation is that the amounts were not returned nor the medical seats arranged as promised. The petitioner was arrested on

04.01.2015 and is in custody since then. The investigation against the petitioner has substantially progressed. It appears that the son is involved in 19 other cases of similar nature and appears to be absconding.

Having considered these facts, I am inclined

to grant bail to the petitioner subject to the following strict conditions:

(a) The petitioner shall execute a bond for a sum of Rs.75,000/- (Rupees seventy five thousand only) with two sureties for the like

sum each to the satisfaction of the jurisdictional Court.

(b) He shall appear before the Investigation Officer on all Mondays and Saturdays between 9.00 a.m. and 10.00 a.m. for a period of two months from the date of their release.

(c) He shall not get involved in any other identical offences.

(d) He shall not threaten, coerce or
