The petitioner is the first accused in Crime No.731 of

2016 of Ottapalam Police Station registered for the offence under Sections 323, 324, 326 and 506 read with Section 34 I.P.C. and Section 4 of the Kerala Prohibition of

Ragging Act.

The prosecution allegation is that on 6.9.2016 at about 11.15 a.m., the petitioner and the other accused who are the students of IDEAL College, committed the offence of ragging against the de-facto complainant , who is also a student of the same college. The petitioner and the other

accused voluntarily caused grievous hurt on him by beating

and kicking him with shoes.

The petitioner was arrested on 27.9.2016 and

ever since he has been in custody.

Heard.

The learned Public Prosecutor has submitted that

major part of the investigation is practically over. The petitioner is aged 20 years. It has been further submitted by the learned Public Prosecutor that the petitioner is not involved in any other offence of similar nature. Considering the facts and circumstances of the case, including the period of detention of the petitioner and the age of the petitioner, I am inclined to grant bail to the petitioner.

In the result, this application stands allowed and the

petitioner shall be enlarged on bail on condition of the

petitioner executing a bond for Rs.30,000/- (Rupees thirty thousand only) with two solvent sureties, each for the like sum to the satisfaction of the Magistrate court concerned

and subject to the following further conditions:-

(i) The petitioner shall report before the Investigating Officer on every Monday between 9.00 a.m. and 11.00 a.m. for three months.

(ii) The petitioner shall not intimidate or influence the witnesses or in any way tamper with the investigation.

(iii) The petitioner shall not get involved in any offence while on bail.
