The petitioner is the accused in Crime No.2682/2016 of Kayamkulam Police Station registered for the offences under Section 375(b) read with Section 376(2)(b) IPC.

The prosecution allegation can be briefly stated

On 27.9.2016 at 1.30 p.m., the petitioner impersonated himself as a clinical doctor and entered into the labour room of Government Taluk hospital, Kayamkulam. Therefater, he examined the de-facto complainant who was pregnant for nine months. The petitioner pressed her abdomen and thereafter, he inserted his finger into the

vaginal tract of the de-facto complainant .

The petitioner was arrested on 28.9.2016 and ever

since he has been in custody.

Heard.

The learned Public Prosecutor has submitted that

major part of the investigation is almost complete. It has been further submitted by the learned Public Prosecutor that the petitioner is not involved in any other offence of similar nature. Considering the facts and circumstances of

the case, including the period of detention of the petitioner

¶30

and the present stage of the investigation, I am inclined to grant bail to the petitioner.

In the result, this application stands allowed and the petitioner shall be enlarged on bail from 25.11.2016 onwards on condition of the petitioner executing a bond for

Rs.30,000/- (Rupees thirty thousand only) with two

solvent sureties, each for the like sum to the satisfaction of

the court concerned and subject to the following further conditions:-

(i) The petitioner shall report before the Investigating Officer on every Monday between 9.00 a.m. and 11.00 a.m. for six months or till the filing of the final report whichever is earlier.

(ii) The petitioner shall not intimidate or influence the witnesses or in any way tamper with the investigation.

(iii) The petitioner shall not get involved in any offence while on bail.
