When the matter was taken up, learned Public Prosecutor on instructions submitted that the petitioners are not accused at present. It was further submitted that a complaint filed by the mother of the deceased is being enquired into. Hence, the application is closed recording the above and reserving the right of the petitioners to move the court with appropriate application in the event of they arrayed as accused. It is further directed that in the event of the petitioners being required in connection with the investigation, notice under Section 41A Cr.P.C. shall be issued to them.
