JUDGMENT

The petitioner has approached this Court with the following

prayers :

i) Call for the records relating to Exhibit P1 to P5 and peruse them;

¶44

ii) Issue a writ of mandamus to respondents 1 and 2 to report the entire vacancies Sub Engineer (electrical) existing as on today to the 3rd respondent immediately; iii) Issue a writ of mandamus or any other appropriate writ, direction or order to the 3rd respondent to notify such vacancies and invite application of eligible candidates and complete selection process within a reasonable time specified by this Hon'ble Court and advise candidates for appointment;

iv) Issue a writ of mandamus or any other appropriate writ, direction or order to the 3rd respondent to complete selection process which commences in pursuance of the notification dated 31.12.2011 within a time of specified by this Hon'ble Court;

v) Award cost of this petitioner.

vi) Issue such other writ, direction or order deemed just and proper in the circumstances of the case.

respondent, pointing out that all the available vacancies have already been reported to the PSC. The version of the respondents is sought to be rebutted by the petitioner, by filing a reply affidavit, producing an additional document as Ext. P6.

Today, when the matter is taken up for consideration, the learned standing counsel appearing for the respondents 1 and 2 submits that, in view of the subsequent development, a fresh study was conducted and '75 vacancies' have been identified. It is stated that, steps are being taken to report the aforesaid vacancies

to the PSC and that, on obtaining 'advice memo' from the PSC, appointment orders will be issued to the eligible candidates.

In the said circumstances, the writ petition is disposed of, directing the respondent Board to report the available vacancies to the PSC, at the earliest, at any rate, within 'six weeks' from the date of receipt of a copy of this judgment.

The petitioner shall produce a copy of this judgment along with copy of the writ petition before the second respondent for further steps.
