J U D G M E N T

Petitioner has approached this Court seeking for a direction to the respondent to issue her passport after effecting certain corrections. The petitioner's name is mentioned in her passport as Usha George instead of Usha Elizabeth George. Her date of birth as shown in the passport is 05/12/1955 whereas according to her, the actual date of

birth is 05/12/1952. It is also stated that the name of petitioner's parents are entered as George Gevarghese Mammen and Annamma George Gevarghese which also requires correction as K.M.George and Annamma George.

Petitioner submitted necessary documents to prove the aforesaid factual errors along with news paper advertisements before the respondent with necessary application. Since no action was taken in the matter, petitioner submitted Ext.P5 representation. Even thereafter,

since no action was taken, this writ petition is filed.

As far as correction of petitioner's date of birth is concerned, the issue is covered by the judgment of this Court in Swapna Siju v. Union of India [2012(4) KLT 419]. Petitioner also requires correction of her name. The correction is only of a minor nature which is also reflected in the Secondary School Leaving Certificate produced as Ext.P1.

Having regard to the aforesaid factual situations, I am of the view that the respondent authority is entitled to make necessary corrections based on the documents produced by the petitioner, after examining the genuineness of the claim.

In the said circumstances, the writ petition is disposed of as under:

i) Respondent shall consider the request of the petitioner in terms of Ext.P3 affidavit and after verifying the particulars received in terms of Ext.P4 receipts and P5

representation, respondent shall take necessary steps to correct the entries in the passport of the petitioner.

ii) This shall be done within a period of one month

from the date of receipt of a copy of this judgment.
