1.Petitioner, claiming to be the Vice President of Tripunithura Town Residents' Association and a social worker, seeks intervention, in public interest, with an order issued by the Government freezing land transactions on the basis of structure plan (General Town Planning Scheme) for Central City of Kochi for widening of the Ernakulam-Vaikom road. We have heard the learned counsel for the petitioner and the learned Government Pleader.

2.The petitioner is not entitled to institute such an application under the cover of public interest. If any individual land holder is aggrieved by the freezing of transactions in relation to any parcel of land, and if that person has sufficient grounds within the format of Article 300A or other provisions of the Constitution of India and relevant statute laws, it may aid such person to have a

personal action against the Government Order freezing land transactions. There cannot be an omnibus public interest litigation in that regard, more particularly because, the plea is pitted against a larger interest noted by the Government, that is to say, widening of the Ernakulam-Vaikom road. Merely because the Government is lethargic in carrying out that proposal, no cause of action arises in public interest against a freezing order.

3.For the aforesaid reasons, we find no ground to issue an order as sought for in this petition, which is styled as a public interest litigation.

In the result, this writ petition is dismissed.
