Petitioner challenges Ext. P2 by which Ext. P1 order has been kept in abeyance until further orders. By Ext. P1, certain directions were issued for providing grace marks for getting admission to higher studies.

In the counter affidavit filed by the 2^nd respondent, it is inter alia stated that the Board noticed that the notification for the Higher Secondary examination was published on 13.11.2013 and the change in grace marks envisaged in Ext. P1 was not mentioned in the same. The Board viewed that the implementation of Ext. P1 would delay the processing and publishing of the results of Higher Secondary Examination conducted in March, 2014 and therefore Ext. P2 came to be passed.

That apart, it is stated that if Ext. P2 is set aside, it will create absolute confusion in the matter. It is also stated that as far as next year is concerned, the matter is pending before the Government for a proper consideration as to whether Ext. P1 is implemented or not.

Having regard to the aforesaid statement in the counter affidavit filed by the 2^nd respondent, I do not think that any direction as sought for is required to be passed.

However, the Government shall consider whether benefits in terms of Ext. P1 is to be given in the next academic year.
