Petitioner is accused in Crime No.590 of 2014 of the Karukachal Police Station for the offences punishable under Sections 468, 471 and 420 of the Indian Penal Code, apprehends arrest and has filed this application.

Allegation is that vehicle belonging to the petitioner was found transporting granite stone under forged pass as if it were issued by the Geological Department.

After hearing both sides this Court passed an interim

order on 03.06.2014 with certain directions/conditions.

Learned Public Prosecutor has submitted that the petitioner was interrogated by the police.

According to the learned counsel petitioner is the owner of several vehicles and those vehicles are given on rental basis to several persons. The pass is (allegedly) obtained in the name of Sreedharan Nair who is engaged in quarrying operation.

On hearing both sides I am satisfied that custodial interrogation of the petitioner is not required. Hence I am inclined

to grant relief but subject to conditions.

Application is disposed of as under:

(i) Petitioner is granted bail in Crime No.590 of 2014 of the Karukachal Police Station.

¶33

(ii) Petitioner shall surrender before the jurisdictional magistrate on 14.07.2014.

¶34

(iii) On such surrender, petitioner shall be released on bail (if not required to be detained otherwise) on his executing bond for Rs.20,000/- (Rupees Twenty thousand only) with two sureties for the like sum each to the satisfaction of the learned magistrate and subject to the following conditions.

(a) One of the sureties shall be a close relative of the petitioner.

(b) Petitioner shall report to the Officer investigating the case as and when required for interrogation.

(d) Petitioner shall not intimidate or influence the

witnesses in the case.

(v) In case the petitioner violates any of conditions (b)
