granted is for construction of a basement floor of 149.61 Sq. metres and ground floor of 133.94 Sq.metres, that as per the plan, the front open space is 6 metres from the main road and on the western side 3 metres and on the south and east 1.5 metres. They have also stated that the plan was approved by the Cochin Corporation on 13.8.2010 and the piling work commenced on 28.1.2012. They have also averred that out of the 52 piles which are required to be erected, 36 have already been erected and 16 piles are remaining to be completed. They have also averred that the trial court which considered the rival contentions held that the petitioners have failed to prove their contention that the construction is being done without leaving the required set back and in violation of the Building Rules and that before the appellate court also no materials were produced to substantiate the said contention.
