J U D G M E N T

The suit is one to set aside a Will (Document No.159/3/09, SRO, Mulanthuruthy) allegedly executed by the mother of the plaintiff and the first defendant in favour of defendants 2 and 3. All that the plaintiff prays is to summon certain documents including the following from the concerned offices.

(i) Proceedings of the Thirumarayoor Service Cooperative Bank Ltd. resolving not to permit the mother of plaintiff and the first defendant to encash a fixed deposit.

(ii) Request to the Sub Registrar, Mulanthuruthy for house registration of Will No.159/3/09.

(iii) The account opening forms and Fixed Deposit renewal application from the Canara Bank, Arakunnam Branch.

The plaintiff has detailed the documents to be summoned in Exts.P3, P5 and P6 applications produced in this original petition.

The counsel for the first defendant does not oppose the prayer and is apprehensive of the delay caused in the exercise. He fairly submits that the documents, if summoned, will facilitate the court to arrive at the truth and will enhance the transparency of the transaction.

I therefore set aside Exts.P10, P11 and P12 orders and allow I.A.Nos.3753/2011, 4762/2011 and 4763/2011 in O.S.No.963 of 2010 on the file of the court of the Subordinate Judge of Ernakulam. The court below shall issue summons to the concerned offices by Special Messenger and see to it that the documents made mention of in Exts, P3, P5 and P6 are made available on or before 28.9.2012. The trial in the suit shall commence without fail on 3.10.2012 and shall proceed on dayto-day basis. Every endeavour shall be taken to have the suit disposed of on merits within a period of two months from the date of receipt of a copy of this judgment.
