The Matrimonial Appeal arises out of the judgment and decree in O.P.No.310 of 2010 on the file of the Family Court, Kasaragod, by which, the application filed by the appellant/petitioner for dissolution of marriage was dismissed. An affidavit is sworn to by the appellant stating that the disputes between the parties have been settled and they agreed to make an application under Section 13B of the Hindu Marriage Act. It is also stated in the agreement that the parties agreed to withdraw all the cases pending before different courts. Accordingly, the appellant prayed for dismissing the appeal as not pressed.
In the light of the affidavit filed by the appellant, the Matrimonial Appeal is dismissed as not pressed.
