only against accused Nos. 1 to 5. As accused Nos.2 and 4 were absconding case against them was split up and re-numbered and the case was proceeded against accused Nos.1, 3 and 5 viz., respondents 2 to 4 herein. PW1 was the then, President of Anchal Service Co-operative Bank. As per the prosecution, on 5.4.1999 at 12.15 noon upon seeing PW1 coming in his scooter the accused persons who gathered at the Anchal - Ayoor public road near the Service Co-operative Bank, Anchal restrained him and attacked and pulled him down. Accused No.1 viz., the second respondent exhorted others to kill PW1 viz., the revision petitioner. On being pulled down from the scooter PW1 stood up and attempted to escape from there. However, the accused persons chased him and he was wrongly restrained. As per the prosecution case, the second accused shouted ( വ�ട� വ��വ��ട� ). Immediately thereupon, the first accused with an intention to murder PW1 wielded the ` vadival ', a dangerous weapon, at his neck. PW1 prevented it with his left hand and as a consequence he sustained fracture on his left hand. A1 again hit him on his left shoulder with the same weapon and caused him further injuries. PWs 2 and 3 took PW1 to the hospital from where his statement was recorded by PW9. Ext.P1 (a) body note was also, then prepared. The F.I.
