Counsel for the appellant submitted that though he
had sent a registered letter to the appellant for getting instructions so as to cure the defect and proceed with the trial, no instruction is received. The above submission of the learned counsel is recorded. In the light of the submission made by the counsel, it appears that the
appellant is not interested in prosecuting the above appeal, which pertains to the year 2003 in which the challenge is against the order of acquittal recorded in favour of the accused under Section 256(1) of the Cr.P.C. based upon the complaint preferred by the appellant. Therefore, the above appeal is dismissed for non-prosecution.
