JUDGMENT

The grievance of the petitioners is that, despite their being the registered contractors for transportation of sand in respect of the Chaliyath Kadavu of second respondent Panchayath, possessing the concerned carriages, they have been sought to be discriminated, in so far the second respondent is adamant in granting transportation to the persons of the choice of the second respondent, which made the petitioners to approach this Court by filing the writ petition, more so, when Exts. P5 and P7 representations preferred before the first respondent in this regard are kept in cold storage.

The learned standing counsel appearing for the second respondent submits that, the petitioners have not approached the said respondent and no proceedings are pending with regard to the issue raised in this Writ Petition.

The learned Government Pleader appearing for the first respondent submits that, the petitioner is to pursue the matter before the second respondent first, and if any order detrimental to the petitioner is passed by the second respondent, same shall be challenged before the first respondent.

In the said circumstances, the petitioners are set at liberty to approach the second respondent by filing a representation before the said respondent to have their grievances redressed, on which event, the second respondent shall consider the said representation in accordance with law, passing appropriate orders, as expeditiously as possible, at any rate within one month from the date of receipt of such representation.

The Writ Petition is disposed of.
