JUDGMENT
The petitioner is the judgment debtor in O.S.No.47 of
2010 on the file of the Additional Munsiff's Court, Kollam. The decree was passed ex-parte. The decree holder levied execution. The petitioner filed an application to set aside the ex-parte decree with a petition for condonation of delay. The petitioner also filed an application to stay the execution proceedings pending disposal of the application for setting aside the ex-parte decree. The executing court dismissed that application which is under challenge in the Original Petition.
