Petitioner, who is the wife of one Jayakumar, seeks anticipatory bail on the allegation that Salabatpura Police in Surat is at her heels in connection with Crime No.240/2010 registered against the petitioner and her husband for allegedly not paying the instalments with regard to a C.T.Scan machine.

Eventhough with regard to a case pending before a court located beyond the territorial limits of the State of Kerala, this Court has no jurisdiction to grant anticipatory bail unless the petitioner is sought to be arrested within the limits of State of Kerala, in view of the decision Madhusoodan v. Superintendent of Police. (1992(2) KLT 83), appropriate orders can be passed to the police charged with the duty of executing the arrest warrant to grant bail to the petitioner and to ensure the presence of the petitioner before the court concerned located outside Kerala. The petitioner is accordingly directed to surrender before the Chief Judicial Magistrate, Pathanamthitta and execute a bond for `25,000/- (Rupees twenty five thousand only) with

two solvent sureties each for the like amount to the satisfaction of that court and subject to the condition that she will report before the Investigating Officer at Surat on 27.06.2011 for interrogation . After such interrogation she shall be permitted to move the concerned Magistrate for regular bail.
