JUDGMENT

The petitioner retired as Assistant Engineer from the service of the Kerala State Electricity Board on 30.11.2009. This Writ Petition is filed aggrieved by the delay in the matter of disbursement of his retiral benefits.

When the matter came up for admission, the learned Standing Counsel for the respondents made available the copy of the communication dated 9.2.2010 received by him from the respondents in which it is stated that an amount of Rs.44,517/-, being the last pay of the petitioner, was disbursed on 14.1.2010 and the terminal earned leave surrender for Rs.4,08,802/- has been sanctioned and the same would be disbursed soon. It is further stated therein that an amount of Rs.3,450/- had been fixed as liability against the petitioner which has been duly remitted by him on 6.2.2010 and having issued the Non Liability Certificate, the pensionary benefits of the petitioner would be sanctioned immediately.

Taking into account the fact that the petitioner has cleared his liability and that Non Liability Certificate has been issued to him and in the light of the submission made by the learned Standing Counsel, based on the communication received by him from the respondents, this Writ Petition can be disposed of with a direction to the respondents to sanction the pensionary benefits to the petitioner as expeditiously as possible, at any rate within a period of one month from the date of receipt of a copy of this judgment. Ordered accordingly.
