The petitioner who is the accused in DRI/CRU 4/2009 on the file of the Directorate of Revenue Intelligence, Kozhikkodu for offences punishable under sections 135 (1) (2) of the Customs Act was granted bail by the Additional chief Judicial Magistrate Court (economic offences), Ernakulam in C.M.P.No.3776/2009. Condition No.2 of the bail order was that each surety has to produce bank guarantee from a nationalised bank for Rs.2 Lakhs. Thereafter, the petitioner was released on bail after he complied with the above condition. His present prayer is to modify the bail condition by allowing the petitioner to produce the original title deeds of the sureties along with original tax receipt instead of cash bond.

The Special Public Prosecutor appearing on behalf of the respondent submitted that there is no objection to the above request. Accordingly, bail condition No.2 of the Annexure 1 order shall stand modified, permitting the sureties to deposit their original title deeds along with tax receipt

instead of cash bond. Upon production of the original title deeds and tax receipt the bank guarantee shall be permitted to be revoked.
