This petition is for anticipatory bail.

¶21

The alleged offences are under Sections 498A and 406 of IPC. According to prosecution, first accused married de facto complainant on 12/01/2003 and thereafter, husband and his family members started harassing her. She was physically and mentally tortured by husband and other relatives.

Learned counsel for the petitioner submitted that he is not pressing the prayer in respect of first accused, since the parties have settled the matter and de facto complainant had gone to Mumbai along with petitioner. They are in good terms with each other. The allegations made against accused numbers two to seven who are mother-in-law and brothers-in-law is that they instigated first accused to commit the offence, it is submitted.

Learned Public Prosecutor submitted that he has no objection in granting anticipatory bail to accused numbers two to seven, taking into account their limited role in the offence.

On hearing both sides, I am satisfied that anticipatory bail can be granted to accused numbers two to seven on conditions. Hence, the following order is passed.

B.A No.1803 OF 2010

(1) This petition, so far as it relates to first accused is dismissed as withdrawn.

(2) Accused numbers two to seven shall surrender before the Magistrate Court concerned within ten days from today.

(3) On such surrender, they shall be released on bail on executing bond for Rs.25,000/- (Rupees twenty five thousand only) each with two solvent sureties each for the like sum to the satisfaction of the

learned Magistrate on the following condition:

(i) They shall report before the Investigating Officer as and when directed and co-operate with

investigation.
