JUDGMENT

The petitioner challenges Ext.P5 order of the Kerala State Election Commission whereby the Commission upheld the maintainability of the original petition as a preliminary issue, dismissing the I.A. filed by the petitioner challenging the maintainability..

I am of opinion that the Election Commission should not make piece-meal adjudication of a petition before it especially in view of the fact that such petitions are to be disposed of in a time bound manner.

In the above circumstances, without prejudice to the right of the petitioner to raise the contention regarding maintainability also while challenging the final order to be passed by the Election Commission, this writ petition is dismissed.
