JUDGMENT

Petitioner was appointed as Lower Division Clerk in the Revenue Department on 28.11.1975, pursuant to an advice by the Kerala Public Service Commission. He was aggrieved by the delay in his promotion to the post of Deputy Collector, on the basis of seniority. His representation was not considered and he retired from service on 31.3.2007. His request was directed to be considered by this Court as per Ext.P1 judgment and Ext.P2 order was passed by the Government finding that the petitioner had been overlooked and his juniors, Sri.A.Radhakrishnan, Smt.Saraswathy and Sri.Sankappa Bangara had been placed above the petitioner. Petitioner was found entitled to re-assignment of seniority, over the aforementioned persons.

On the basis of such re-assignment of seniority amongst the Lower Division Clerks, petitioner sought for notional promotion to the post of Deputy Collector. Request made in this regard as per Ext.P4 is pending before the 1^st

respondent. This writ petition has been filed seeking appropriate directions in relation to Ext.P4.

respondent shall consider Ext.P4 and take a decision in the light of Ext.P2, after hearing the petitioner, within three months from the date of receipt of a copy of this judgment.
