If a vacancy arises in the school, the same has to be filled up by the Manager in accordance with law after considering the claims of the appellant, the 1st respondent and other claimants, if any. Since the claim of the 1st respondent under Rule 51A relates to the period 2000-01, the same cannot override a claim under Rule 43 of Chapter XIVA KER. We notice that Rule 51A has been amended with effect from 17.06.2005. After the amendment, only those who are appointed in a vacancy having a duration of one academic year, will be treated as claimants under Rule 51A. Such claimants will have preference over the claimants under Rule 43. In this case, the 1st respondent's claim, as mentioned earlier, relates to the period 2000-01. Therefore, the submission made by the Manager, which is recorded by the learned Single Judge for disposing of the Writ Petition, cannot be sustained. In the result, the Writ Appeal is allowed. It is ordered that if any vacancy arises in the cadre of HSA (Mathematics) in future, the Manager shall fill up the same in accordance with the provisions of the Kerala Education Act and Rules, taking into account the claims of various incumbents working in the school on the date of occurrence of vacancy.
