This is an application for bail under Section 439 of the Code of Criminal Procedure. The petitioner is accused No.1 in Crime No.50 of 2008 of Koodal Police Station in Pathanamthitta District.

The offence alleged against the petitioner and other accused is under Section 379 read with Section 34 of the Indian Penal Code.

The prosecution case is that on 29.2.2008, the accused persons committed theft of a Scorpio car. The petitioner was detained in Coimbatore jail in connection with another theft case. The formal arrest of the petitioner in the present case was recorded on 22.6.2009.

It is submitted by the learned Public Prosecutor that the petitioner is involved in several other theft cases. The investigation

of the case is not over. If the petitioner is released on bail, he will make himself scarce. In respect of the incident in February, 2008, his arrest could be recorded only in June, 2009. I do not think that the petitioner can be released on bail at this stage.
