This civil revision petition is filed against the award of the Addl. District Judge, Alappuzha, in OP (EA) 54/97, whereby the court below has awarded an enhanced compensation of Rs.31,500/-. The court found that the extent of land affected is only about 15 cents and fixed the land value at Rs.7,000/- per cent, calculating the diminution of land value at 30%, awarded enhanced compensation of Rs.31,500/-. The court below has considered Ext.A1 as a guideline for fixing the market value. It also considered the factual matrix available to fix the percentage of diminution. Though it was averred that the entire land has become useless, the court found that only 15 cents of land is affected and fixed the diminution of land value at 30%. Similarly, considering the number of trees cut and removed and the area affected, the court had taken only 15 cents for the purpose of considering the diminution of land value. So all the matters had been taken into consideration in the correct perspective and only a reasonable compensation is awarded.
