Heard the learned counsel for the petitioner husband and the learned counsel for the 2nd respondent wife. In the light of the counter affidavit dated 02.04.2008 filed by the 2nd respondent, it appears that the FIR in Crime No. 75 of 2004 before the Munnar Police Station was registered under a mistaken impression entertained by the 2nd respondent. The petitioner and the 2nd respondent may file an affidavit before the Investigating
Officer who shall thereafter close the case in accordance with the affidavit.
This Crl.M.C. is disposed of as above.
