Heard. Leave having already been granted this appeal is admitted.

This appeal is directed against the order passed under Section 256 Cr.P.C. in a prosecution under Section 138 of the N.I. Act dismissing a complaint filed by the petitioner/ complainant alleging commission of the offence under Section 138 of the N.I. Act.

The cheque is for an amount of Rs.2,23,486/- The order sheet has been perused. It shows that from 29.8.2000 to 13.8.2003 the complainant was prosecuting the complaint diligently. On some days he was present and on some he was not present. He was represented by his counsel. On 13.8.2003 the case was adjourned to 18.9.2003 as there was no sitting of the court. On 18.9.2003 and 29.10.2003, to which dates the case was adjourned, the complainant was absent. There was no

representation on his behalf. The direction to produce postal covers to issue summons to the accused through registered post issued on 18.9.03 was not complied with. It was in these circumstances that the complaint stood dismissed on 29.10.2003.

The learned counsel for the petitioner submits that the petitioner was diligently prosecuting his complaint all through. Since there was no sitting on 13.8.2003, the date of next posting was not announced in open court. According to him, the petitioner and his counsel were contacting the Bench Clerk to get the date of adjournment. They were not aware of the fact that the case was posted to 18.9.03 and later to 29.10.2003. It was in these circumstances that the petitioner remained absent on 18.9.2003 and 29.10.2003. There was absolutely no reason for the petitioner not to appear before court and prosecute the case. It is only because of the inability to secure the date of the next posting on 13.8.2003 that the petitioner and his counsel were absent on 18.9.03 and 29.10.2003. In these circumstances a lenient view may be taken. There is no reason to assume that the petitioner is not interested in prosecuting his complaint.

Having considered all the relevant inputs, I find merit in the submission of the learned counsel for the petitioner. I am satisfied that a lenient view can be taken and the petitioner can be granted a further opportunity to prosecute his complaint. The accused had not entered appearance before the learned Magistrate and I am satisfied that it is not necessary to wait for issue and return of notice to the respondent/accused.

In the result:

a) This criminal appeal is allowed.

b) The impugned order passed under Section 256 Cr.P.C. is set

aside.

c) The learned Magistrate is directed to dispose of C.C.1962 of 2000 afresh in accordance with law.

d) The petitioner shall appear before the learned Magistrate on 30.9.2008 with a copy of this judgment to continue the proceedings.
